Case Type: Freedom of Speech, Freedom of Religion (buffer zones)
Being a mother of 13, Kathy knows all too well the challenges of having and raising children. She is also very good at it.
That is why Kathy believes her Christian ministry is to reach out to mothers in need and help them.
For some years, Kathy has stood near Melbourne abortion clinics as part of a small group of sidewalk counsellors called the Helpers of God’s Precious Infants.
The Helpers make simple offers of help to women approaching the clinic. Many refuse and are left alone. Others want to talk. Through these simple conversations, the Helpers have seen literally hundreds of babies born alive who would otherwise have been aborted.
This is because the Helpers provide whatever support a mother needs to have her child. Whether it be safe haven from domestic violence, practical in-home help and guidance, babysitting help, financial assistance, or basic baby supplies. Nothing is too much.
When the buffer zones legislation passed in Victoria, Kathy was determined that this Christian ministry should continue. Unfortunately, she was charged with breaching the buffer zone by “communicating in a way that can be seen or heard on the subject of abortion” within 150 meters of a clinic.
The Human Rights Law Alliance is arranging legal representation for Kathy.
Lawyers will argue that the buffer zones are at least partly invalid by reason of the implied freedom of political communication in the Australian Constitution.
